Please read these website Terms and Conditions (T&C) carefully before using this website and services. These T&C apply to your access to and use of the website. The T&C apply when you visit, browse access or use the website and services. By using the website, you shall be deemed to accept these T&C. If you do not accept these T&C you must not access or use the website.

This website is operated by   PSN Recruitmenst Ltd. trading as Cosmopolitan Recruitment (“Cosmopolitan Recruitment”, “we” us” “our”). We are registered in England. Registered company number 12319623. Our registered office is at Kemp House, 152 City Road, London EC1V 2NX.

We reserve the right to update the website T&C from time to time in our sole discretion. If we make changes to these T&C we will post updates on our home page.

  1. ELIGIBILITY TO USE THIS WEBSITE

The website and any related services are available to you, provided that you can form legally binding agreements under applicable law. This website is not intended to be used by minors (those under the age of 18). If you are a minor, please do not use the website.

  1. LICENCE.

Cosmopolitan grants you a limited, non-exclusive, non-transferable, non-assignable, revocable license to view and temporarily download a copy of the materials displayed on the website solely for your personal non-commercial use. All materials displayed or made available on the website, including, but not limited to, graphics, documents, text, images, sound, video, audio, artwork, software, and HTML code (collectively “Material”) are exclusive property of Cosmopolitan or its content suppliers. The Materials are protected by U.S. and international copyright laws and any other applicable intellectual property rules, regulations, and laws. Except as expressly permitted herein, you shall not: (i) use, copy, modify, display, delete, distribute, download, store, reproduce, transmit, publish, sell, re-sell, adapt, reverse engineer, or create derivative works of the Material; or (ii) use the Material on other websites or any media, e.g., networking environment, without Cosmopolitan’s prior written consent. Information necessary to achieve interoperability of any software downloaded, in accordance with the above license, with other independently created software programs will be made available by us on request and on payment of our reasonable costs for providing the same.

All trademarks, service marks, and logos (the “Marks”) displayed on the website are exclusive property of Cosmopolitan and or their respective third-party owners. You shall not use the Marks in any manner without Cosmopolitan’s and / or their respective third party owners’ prior written consent.

  1. YOUR / USER SUBMISSIONS.

Before submitting Personal Information (e.g. your name, personal address, telephone number and email address, etc.) you should carefully read our Privacy Policy. We shall have the right to process, copy, share, disclose and transfer Personal Information that you submit to the website for the purposes described in our Privacy Policy.

You acknowledge and accept that our website is only a passive forum for users to obtain employment and career information.

Cosmopolitan reserve the right, in its sole discretion, to delete, remove, refuse to display, or block any Personal Information that you submit via the website that Cosmopolitan considers to be unacceptable (as set out in section 7 of these T&C). In the event Cosmopolitan receives notification regarding any unacceptable data submitted, Cosmopolitan may, at its sole discretion, investigate and remove such data.

You accept that we may disclose your Personal Information to a third party if we believe that it is necessary to: (i) protect the integrity of the website; (ii) protect the rights of Cosmopolitan; (iii) comply with any court order; (iv) comply with any legal proceedings; (v) assert Cosmopolitan’s claim under these T&C; and (vi) satisfy any claims regarding violations of third party’s rights.

Cosmopolitan will process any Personal Information you provide through your use or access of the website in accordance with its Privacy Policy and any specific terms set out on the relevant part of this website.

  1. GENERAL PROHIBITION.

When accessing and using the website, you agree NOT to:

(a) violate any local, state, and federal rules, regulations and statutes, including, but not limited to, anti-discrimination, or equal opportunity employment laws;
(b) infringe any intellectual property and privacy rights, including, but not limited to, patent, copyright, trade mark or trade secrets rights of any third party;

(h) copy, modify, reproduce, delete, distribute, download, store, transmit, sell, re-sell, publish, reverse engineer, or create derivative works of any Materials, except that have been submitted and owned by you;

  1. EMPLOYMENT OPPORTUNITIES.

NOTHING IN THIS TERMS OF USE AFFECTS ANY LIABILITY WHICH COSMOPOLITAN MAY HAVE FOR DEATH OR PERSONAL INJURY ARISING FROM COSMOPOLITAN NEGLIGENCE OR FOR ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED BY LAW.

 

  1. TERMINATION.

Cosmopolitan has the right, in its sole discretion and at any time, restrict access to all or some parts of the website and / or to terminate any services provided via the website and / or remove any data and materials submitted to or published on the website. Cosmopolitan may at any time without notice, restrict, deny or terminate your access to any part or all of the website and services if, in our opinion you have failed to comply with these T&C.

  1. GENERAL.

You agree that there is no employment, partnership, agency, or joint venture relationship between you and Cosmopolitan arising out of or resulting from your access or use of the website.

These T&C constitute the entire agreement between you and Cosmopolitan governing your access and use of the website and is additional to any binding agreement between you and Cosmopolitan.

If you view, access, submit, or download materials to and from the website outside the United States, you will be solely responsible for all your actions and assume all risks. You may not use or export any Materials or make any copy or adaptation in violation of any application laws, rules, or regulations, including, but not limited to, U.S. and other applicable export laws and regulations.

Sections 4, 6, 7, 8, 10, 12, 13, 14, 15, 16, 17, and 18 shall survive any termination of these T&C.

  1. THE LAW APPLICABLE TO DISPUTES

These T&C shall be governed by the laws of England and you agree that the English courts shall have exclusive jurisdiction in relation to any claim’s issues and disputes (contractual and non-contractual) arising under or in connection with these T&C.

If we change these T&C we will post any updates here for your review and provide notice of the revised T&C for 30 days on the home page of this Website at www.cosmopolitanrecruitment.co.uk with a link back to these T&C.
